When an individual operates a moving vehicle while under the influence of drugs or alcohol, he/she is considered to be driving under the influence. Driving under the influence of drugs or alcohol seriously impairs an individual's ability to concentrate on the road, and decreases his/her level of alertness.
An individual is considered intoxicated and too impaired to operate a vehicle when his/her blood alcohol content (BAC) is 0.08% or higher. Under California's zero tolerance policy, individuals under the age of 21 may not operate a vehicle if their BAC is higher than 0.01%. If the driver's BAC exceeds the legal limit, he/she will be arrested and charged with a
DUI.
Driving under the influence (DUI) is a serious criminal act that law enforcement officials and the courts do not take lightly. Driving while intoxicated drastically increases the chances of
causing an accident, injury or death. If you have been charged and convicted of a
DUI, you could face
harsh punishments including jail time, heavy fines, probation, suspension or revocation of your
driver's license, rehabilitation, community service, and a mark on your permanent record.

Breathalyzer Calibrations - DUI Defense
If you are being charged with driving under the influence, contact our drunk driving lawyers and we will start discussing your options and your defenses.
A common DUI defense is the breathalyzer test and whether or not the testing device was working properly at the time of the test.
Breathalyzers require regular calibration and maintenance to ensure the accuracy of the results. An improperly calibrated or inadequately maintained machine will produce unreliable results. The breathalyzer devices must be calibrated every 10 days or every 150 people tested; this assures accuracy. Failing to do so may produce inaccurate results.
Our DUI Defense Attorneys will thoroughly investigate everything that occurred during your arrest for driving under the influence and will do our research to see if the breathalyzer device used to determine your blood alcohol level was properly calibrated and maintained.
If we find any slight possibility that the device was improperly calibrated, we will have the evidence of your blood alcohol level thrown out.
If you are facing DUI charges, contact our drunk driving lawyers immediately and we will begin investigating and researching. Our goal is to protect your freedom, your driver license, your reputation, and your legal rights!
