Our Los Angeles DUI Defense Attorneys are the DUI Kings of Los Angeles. We have a combined 75 years of experience and we have handled thousands and thousands of DUI cases.

Our clients are always pleased because our persistence and dedication is evident to them. Our DUI Lawyers know all the ins and outs of the DUI process. We handle both the criminal proceeding and the DMV hearing and prepare for both proceedings as if preparing for a trial.

If you are facing a driving under the influence charge, as your  DUI Defense Lawyer we assert any and all defense applicable on your behalf and we do so aggressively.

There a number of ways to challenge a DUI charge. First, we investigate to see if the stop was even legal. The fourth amendment of the Constitution prohibits unreasonable searches and seizures and a traffic stop is considered a seizure. As your attorney, we would investigate to see if the police officer who stopped you at the time of your arrest had a reasonable suspicion to make the stop.

If we can argue this defense on your behalf, your case will likely get dismissed.

Another way to challenge a DUI is by questioning the breathalyzer test. Breathalyzer devices are not always accurate and our job as your DUI Attorney is to do our research and find out if the devices have been properly calibrated and maintained.

Inaccurate results will also have your case likely dismissed.

Our primary goal is to have your case dismissed. We want to protect your freedom, your rights, your license, and your reputation. We guarantee our dedication, our competence, and our persistence.

If you are facing a driving under the influence charge, do not waste any time andcontact our Los Angeles DUI Attorneys and set up a free case evaluation.

Low Zinc Diet May Cost You a DUI Charge
Posted By Admin
Scientific research shows that a high blood-alcohol level may not be a result of high alcohol consumption. According to a study performed at the University of North Dakota, researchers discovered that the metabolism of alcohol is dramatically affected by zinc intake. In the subjects on a low zinc diet, blood-alcohol levels increased rapidly within 15 minutes of consumption of measured amounts of alcohol. About twice as much alcohol was present in their blood as was present in the subjects with normal zinc diets. In addition, greater amounts of alcohol remained in the blood for longer periods of time for those with a zinc deficiency. Zinc deficiencies tend to develop in individuals who regularly consume large amounts of alcohol. This deficiency will cause a higher alcohol concentration and slower elimination, resulting in abnormally high blood-alcohol tests.

Are Sports Fans More Likely to get a DUI?
Posted By Admin
The University of Minnesota conducted a study which determined that one in every 12 fans leaves a major sporting event while intoxicated. Researchers measured the blood alcohol content of 382 adults who had attended baseball and football games and found that 8% of the fans registered a blood alcohol content in excess of the legal limit. Those who participated in tailgating before a game were 14 times more likely to be drunk when leaving the sports venue.

The researchers conducted the study by approaching fans at professional sporting events and asking them to submit to an anonymous breath test and answer a five minute survey. An average of 20 fans per event participated in the study. 58% of them were male, and 55% were between the ages of 21 and 35.

A major concern is that the intoxicated fans are likely to be driving home, which could lead to drunk driving accidents and injuries.

What is the most accurate DUI test in Los Angeles?
Posted By Admin
The most accurate test to register what a person's blood alcohol level is, at any given time, is to draw blood. The police do not like to have a person get their blood drawn and will discourage them from taking the blood test.

Many clients have come in and said that the police told them that if they gave blood, they would be in custody longer. The reason the police do not like to permit a person to give a blood sample versus a breath test is simple, it is because it takes too long and requires more work on their part. Technically, by discouraging a person from giving blood, the police are violating the dictates of the Implied Consent Law. Otherwise, what is the point of having a choice, if a person is tricked or pressured into taking the blood test. The problem is, that proving this improper conduct can be very difficult. There are so many factors that can be attacked related to the methods and circumstances surrounding a DUI case. However, to really evaluate whether you should fight your case, you must speak to a seasoned Los Angeles DUI attorney.

  Can Mouthwash Increase BAC Levels?
Posted By Admin
Carol Ries, 50, pleaded guilty to drunk driving after crashing into the back of a car at a stoplight. When pulled over she admitted to drinking 3 glasses of Listerine that afternoon, and police found a bottle of the Pfizer-manufactured mouthwash in Ries' car. Her BAC from a breathalyzer registered lower than the 0.08 legal limit, but a second test was administered to her using a different device. That test measured her BAC at 0.30. Listerine contains between 26.9% and 21.6% alcohol. The open bottle of alcohol in the car charge was dropped, but she may still have to serve up to 93 days in jail and pay a $500 fine for drunk driving.

Alcohol based mouth-wash can increase your BAC level because the alcohol can stay in your mouth and then be blown into the breathalyzer. That alcohol is thought to evaporate within 15-20 minutes. For this reason, it is important that police wait about 15-20 min. before administering a breath test when pulling someone over.

Could You Be Convicted of DUI if You are Sitting in Your Car?
Posted By Admin
When it comes to being convicted of a DUI, many people have questioned what constitutes "driving" a vehicle. Would someone sleeping or sitting in their car be considered to be "driving" according to the law. What if someone is outside their car leaning on the car, or if someone has the keys in the ignition, are they "driving" their car? After facing many similar circumstances, the court was forced to come up with a definition of what constitutes "driving".

Driving is considered the operation of a vehicle and the controling of a vehicle. Operating a vehicle is also what is referred to as driving or having the car moving. Controlling has to do with the keys. If you have the keys you have control.

In People v. Bellomo(1984) it wasn't necessary to decide whether or not the defendant was driving in the presence of the arresting officer because the defendant was found asleep behind the wheel, with the engines running, in a traffic lane, awaiting a red light. He was found guilty (40300.5). This evolved into, if you have the keys, and you are in the vehicle or about the vehicle and "if it looks like a duck, smells like a duck, it must be a duck".

If you or someone you know has been arrested for DUI and feel that the charges are unwarranted, call our office today to set up a free face-to-face consultation. The DUI attorneys at the Hedding Law Firm will sit down with you and collect all the facts pertaining to your unique case.
