The most accurate test to register what a person's blood alcohol level is, at any given time, is to draw blood. The police do not like to have a person get their blood drawn and will discourage them from taking the blood test.
Many clients have come in and said that the police told them that if they gave blood, they would be in custody longer. The reason the police do not like to permit a person to give a blood sample versus a breath test is simple, it is because it takes too long and requires more work on their part. Technically, by discouraging a person from giving blood, the police are violating the dictates of the Implied Consent Law. | Can Mouthwash Increase BAC Levels? |

Carol Ries, 50, pleaded guilty to drunk driving after crashing into the back of a car at a stoplight. When pulled over she admitted to drinking 3 glasses of Listerine that afternoon, and police found a bottle of the Pfizer-manufactured mouthwash in Ries' car. Her BAC from a breathalyzer registered lower than the 0.08 legal limit, but a second test was administered to her using a different device. That test measured her BAC at 0.30. Listerine contains between 26.9% and 21.6% alcohol. The open bottle of alcohol in the car charge was dropped, but she may still have to serve up to 93 days in jail and pay a $500 fine for drunk driving.
Alcohol based mouth-wash can increase your BAC level because the alcohol can stay in your mouth and then be blown into the breathalyzer. That alcohol is thought to evaporate within 15-20 minutes. For this reason, it is important that police wait about 15-20 min. before administering a breath test when pulling someone over.

| Could You Be Convicted of DUI if You are Sitting in Your Car? |

When it comes to being convicted of a DUI, many people have questioned what constitutes "driving" a vehicle. Would someone sleeping or sitting in their car be considered to be "driving" according to the law. What if someone is outside their car leaning on the car, or if someone has the keys in the ignition, are they "driving" their car? After facing many similar circumstances, the court was forced to come up with a definition of what constitutes "driving".
Driving is considered the operation of a vehicle and the controling of a vehicle. Operating a vehicle is also what is referred to as driving or having the car moving. Controlling has to do with the keys. If you have the keys you have control.
In People v. Bellomo(1984) it wasn't necessary to decide whether or not the defendant was driving in the presence of the arresting officer because the defendant was found asleep behind the wheel, with the engines running, in a traffic lane, awaiting a red light. He was found guilty (40300.5). This evolved into, if you have the keys, and you are in the vehicle or about the vehicle and "if it looks like a duck, smells like a duck, it must be a duck".

| Grandma Begs Officer Not to Charge Her with DUI |

A 65 year old woman tried to avoid a DUI arrest by offerring to make the police officer a grilled cheese sandwich. Elsie Wright O'Conner was stopped after reports of a erratic driver. Her breath smelled of alcohol and two bottles of Skyy Vodka were found in her SUV. One of the bottles was empty and the other was half full. The woman pleaded with the officer to not charge her, stating that she was a grandma and not bad. She told the officer "I could have brought you back to my house and made you a grilled cheese sandwhich." The woman failed the field sobriety test, and her BAC registered as more than three times the legal limit.

| George Michael Released From Jail after DUI |

George Michael was released from Jail Monday after serving almost four weeks for driving under the influence of drugs. "I just want to start again." Said the singer as he thanked those who had supported him while he was jailed. Michael received an eight week sentence on September 14, 2010 after crashing his car into a London photo shop. In July, while high on prescription drugs and marijuana, the singer received a 1,250 pound (about $2,000) fine and lost his license for five years.

| Drunk Driver Rear-Ends Transit Bus Injuring Two People |

Jeane Dexheimer, 51, was placed into custody on suspicion of drunken driving after she rear-ended a transit bus. The bus had 10 passengers on board; the driver and one other man were taken to a hospital after complaining of back pain.
Under California Vehicle Code section 23153 VC, you may be charged with a "DUI with injury" if you injured another person while driving under the influence. This charge could be prosecuted as either a misdemeanor or as a felony depending on the circumstances of the offense, and your criminal history. Your DUI history will especially play a big role.
